1. Preamble:
   “Wunderfell” is a B2C platform for consumers as defined in Section 13 of the German Civil Code (BGB).
2. Scope:
   2.1 The following General Terms and Conditions apply between the Seller and consumers as defined in § 13 of the German Civil Code (BGB) with respect to products offered and sold by the Seller through the online store.

   2.2 These General Terms and Conditions apply exclusively. Any deviating, conflicting, or supplementary general terms and conditions of the buyer shall become part of the contract only if and to the extent that the seller has expressly agreed to their validity. This requirement for consent also applies if the buyer refers to its general terms and conditions in the order and we have not expressly objected to them.

3. Conclusion of the Contract:
   The purchase contract is concluded either when the seller confirms, within five business days, the buyer’s binding offer contained in the order in accordance with § 145 of the German Civil Code (BGB) via email, or when the seller ships the ordered goods in accordance with the provisions of Section 6.
4. Prices and Payment:
   4.1 Unless otherwise agreed in writing in individual cases, the prices in effect at the time the contract is concluded, ex warehouse from the Seller, plus applicable sales tax, shall apply. Unless a fixed-price agreement has been made, the Seller reserves the right to make reasonable price adjustments due to changes in labor, material, and distribution costs for deliveries made 3 months or more after the contract is concluded.

   4.2 In addition to the listed prices, the seller charges shipping costs per order. The shipping costs listed on the product pages, in the shopping cart, and on the order page apply. Shipping costs may vary for deliveries within Germany and for international deliveries.

   4.3 Payment of the purchase price must be made exclusively to the seller using the following payment methods:
   – advance payment via direct bank transfer (no discounts accepted),
   – PayPal,
   – Klarna,
   – credit card (Visa, Mastercard, Amex),
   – Giropay,
   – Apple Pay

   4.4 Invoices are due for payment in full as of the invoice date.

   4.5 If, after the conclusion of the contract, it becomes apparent that the right to payment of the purchase price is at risk due to the buyer’s inability to pay, the seller is entitled, in accordance with statutory provisions, to refuse performance and, if necessary after setting a deadline, to withdraw from the contract (Section 321 of the German Civil Code (BGB)). The statutory provisions regarding the dispensability of setting a deadline remain unaffected in this respect.

   4.6 The buyer is entitled to set off claims against the seller’s claims only if the counterclaim asserted by the buyer is undisputed, has been acknowledged in writing by the seller, or has been established by a final and binding court decision.

5. Delivery, Delivery Times, Transfer of Risk:
   5.1 Unless otherwise expressly agreed, the Seller will ship the goods to the address specified by the Buyer within the EU, Switzerland, and Norway. Shipments to other countries are possible only by express agreement.

   5.2 Upon delivery of the goods to the shipping agent, carrier, or other transport provider, the risk of accidental loss of the goods shall pass to the buyer. If the buyer is a consumer, § 475(2) of the German Civil Code (BGB) shall apply.

   5.3 The Seller will ship the goods within 7 days of receipt of payment, using the shipping method selected by the Seller, to the delivery address specified in the order.

   5.4 Delivery is made ex warehouse. The warehouse also serves as the place of performance for the delivery and as the location for any subsequent performance.

6. Right of Withdrawal & Right of Withdrawal:
   6.1 Consumers have the right to cancel in accordance with the following cancellation policy:
   6.1.1 Right of Withdrawal:
   The buyer has the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which the seller or a third party designated by you, other than the carrier, took possession of the goods.
   If the buyer has ordered multiple items as part of a single order and the items are delivered separately by the seller, the cancellation period is fourteen days from the day on which the buyer or a third party designated by the buyer—other than the carrier—took possession of the last item.

   To exercise your right of withdrawal, the buyer must notify Marlino GmbH, Frankfurter Ring 247 / RGB, 80807 Munich, Germany, Fax: +49 89 452058811, Email: info@marlinogroup.com by means of a clear statement (e.g., a letter sent by mail, fax, or email) regarding your decision to withdraw from this contract. The buyer may use the attached sample withdrawal form for this purpose, although its use is not mandatory.

   To comply with the cancellation period, it is sufficient for the buyer to send the notice of cancellation before the cancellation period expires.

   6.1.2 Consequences of Withdrawal:
   If the buyer withdraws from this contract, the seller must refund to the buyer the payments the seller has received from the buyer, excluding shipping costs, without delay and no later than fourteen days from the day after the seller has received the returned goods. The seller will use the same payment method the buyer used for the original transaction to make this refund, unless expressly agreed otherwise with the buyer; under no circumstances will the buyer be charged any fees in connection with this refund. The seller may withhold the refund until the seller has received the goods back.

   The buyer must return the goods to the seller immediately and, in any case, no later than seven business days. The deadline is met if the buyer ships the goods before the seven-business-day period expires.

   The buyer is responsible for the direct costs of returning the goods.

7. Warranty:
   7.1 The buyer is entitled to a warranty for defects in the purchased goods in accordance with statutory provisions. The buyer’s claims for defects are initially limited to a right to subsequent performance. The buyer must grant the seller a reasonable period of time to perform the subsequent performance. A period is considered reasonable if it enables the seller to complete the work already undertaken. The buyer may, in accordance with statutory provisions, rescind the purchase contract or reduce the purchase price if a period set by the buyer for subsequent performance has expired without result or is not required under statutory provisions. However, in the case of a minor defect, the buyer has no right of rescission.
8. Liability:
   8.1 The seller is liable in accordance with statutory provisions for injury to life, bodily injury, or harm to health; in the event of a defect where the Seller has assumed a warranty for the quality of the goods; in the case of defects fraudulently concealed; provided that the Buyer’s damage results from an intentional or grossly negligent breach of duty by the Seller, a legal representative of the Seller, or a vicarious agent of the Seller; and within the scope of the Product Liability Act.

   8.2 The Seller is also liable for negligent breaches of material obligations, the breach of which jeopardizes the achievement of the purpose of the contract, or for breaches of obligations whose fulfillment is essential to the proper performance of the contract and on whose compliance the Buyer regularly relies. In this case, however, the Seller shall be liable only for foreseeable damages typical for this type of contract.

   8.3 In all other respects, the seller is not liable for breaches of duty.

9. Applicable Law:
   9.1 This Agreement is governed by German law, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods.

   9.2 If the buyer is a merchant as defined by the German Commercial Code, a legal entity under public law, or a special fund under public law, Munich shall be the exclusive venue for all disputes arising directly or indirectly from the contractual relationship. The seller may also bring an action against the buyer at the buyer’s place of business.
